Synopsis
Offering students, legal practitioners and lay persons a succinct exposition of the letter and spirit of Institutional law of the European Copmmunities and European Union, this work includes recent developments. The author examines the conceptual apparatus of the EU, the general objectives which the EU is supposed to perform, and the methods and techniques employed by the Community Institution and Member States for the achievement of those ends. Included are many topics not always found in textbooks, including the general historical background of European integration, the socio-political structure of Europe today, the requirements for admission of new members, the challenge of enlargements, withdrawal from the EU, internal and external competencies of the European Communities and a detailed analysis of the three pillar structure of the EU since the Treaty of Maastricht. Particular attention is paid to areas which students find the most difficult: general principles of Community law including direct effect, direct applicability and supremacy of EU law, direct actions before the Court of Justice of the European Communities (ECJ), the application of Community law in Member States along with the newly introduced sanctions for non-compliance under Article 171(2) EC.
